Get The Maximum You’re Entitled To For Your Negligence Claim

At Peninsula Personal Injury Lawyers, we understand that not all cases fall neatly into categories, for example, car accidents or workplace incidents. If you’ve been harmed due to someone else’s negligence, even outside of typical scenarios, you may still have the right to seek compensation under Western Australian law.

“Other negligence claims” cover a wide range of personal injury situations where a duty of care has been breached, causing you harm. Whether your injury occurred in a recreational setting, on private property, due to professional misconduct, or even in a healthcare environment that doesn’t meet the criteria for a formal medical negligence case, we’re here to help. Our experienced team in Mandurah can assess your unique situation and provide clear, straightforward advice about your options.

    Important Steps to Take

    1. Report and Document the Incident – Notify the relevant party in writing and request preservation of any CCTV footage. Visit your doctor to report your injuries and obtain medical certificates for any time off work.
    2. Be Aware of Insurer Involvement – The relevant party should notify their insurer, but you may not receive a response or an admission of liability. This does not mean you’re not entitled to compensation.
    3. Seek Legal Advice Early – Regardless of insurer response, obtain legal advice to ensure you’re properly guided through the claims process. Contact us for a free, no-obligation consultation.

    Will This Cost Me Anything?

Many people think hiring a lawyer is expensive and risky, but that’s not the case at Peninsula Personal Injury Lawyers. We work on a No Win, No Fee basis, meaning if your negligence claim is successful, the insurer pays your compensation, most of your legal costs, and any disbursements (such as medical reports and evidence). From your compensation, you’ll only pay the remaining legal costs, capped at 10% or the actual amount, whichever is less. Never more than 10%.

If your claim isn’t successful, you pay no legal fees. You’ll only need to reimburse us for any disbursements we’ve covered on your behalf, and we never ask for money up front. There are no hidden costs; we’re transparent from the start.

(e.g. if your claim came to $50,000 then you would only ever pay a maximum of $5,000 as a contribution to the legal fees)

      Frequently Asked Questions

Not always. Most negligence claims are resolved through negotiation and settlement outside of court. However, if a fair agreement cannot be reached, court proceedings may be necessary. Peninsula Personal Injury Lawyers will guide and represent you every step of the way.

      Compensation may cover:

      • Medical and rehabilitation expenses.

      • Loss of income and future earning capacity.

      • Pain and suffering.

      • Care and support needs.

Every case is unique, and the amount depends on the impact of your injury on your life.

      Some examples include:

      • Injuries caused by unsafe premises (slips, trips, and falls).

      • Sporting or recreational accidents due to poor supervision or unsafe conditions.

      • Professional negligence (such as incorrect advice causing harm).

      • Injuries from faulty products.

If you’re unsure, our team can advise whether your situation qualifies.

While you can make a claim on your own, having a personal injury lawyer ensures your rights are fully protected. A lawyer can handle negotiations with insurers, gather evidence to support your case, and maximise your compensation.

In most cases, you must notify the owner/ occupier that you suffered injury as soon as practicable following the accident. In addition, you must commence legal proceedings within three years of the date of the accident otherwise your entitlements will be extinguished.

However, some exceptions may apply, especially for minors or people with disabilities, so it’s best to seek legal advice as soon as possible.

To have a claim, you generally need to show that:

      1. The other party owed you a duty of care.

      2. They breached that duty by acting (or failing to act) reasonably.

      3. You suffered injury, loss, or damage as a result.

Speaking with one of our experienced personal injury lawyers can help you assess whether your circumstances meet these requirements.

At Peninsula Personal Injury Lawyers, we work on a No Win, No Fee basis. This means you don’t pay any legal fees unless your claim is successful. During your first consultation, we’ll clearly explain any costs and the claims process so you know exactly what to expect.

To book your Free Initial Consultation with one of our Solicitors, please contact our office on (08) 9581 4339 to speak with our friendly New Client Liaison. Alternatively, you can fill out the Online Enquiry Form (link), and our New Client Liaison will reach out to you within 1 business day to arrange your Free Initial Consultation.

You will be asked to provide basic details about yourself, details about the circumstances surrounding your injury, your insurer claim number (if applicable) and claim status (if applicable), together with any medical reports and certificates you may have. These details are necessary for our Solicitors to provide you with accurate legal advice.

When you engage PPIL you won’t pay anything throughout the whole claims process. Once we have settled your claim, we’ll then determine how much our services cost. The majority of our fees will be covered by the insurance company, and we also place a cap on the fees you pay which is based off of your claim.

So, if you do end up having to pay anything, it would only come to a maximum of 10% of your claim.
