If you’ve been injured in a public or private place in Western Australia, such as a shopping centre, park, footpath, or car park, you may be entitled to make a public liability claim.
Property owners and occupiers have a legal duty to take reasonable care to ensure their premises are safe for the public. If your injury is a result of negligence on the part of the owner, such as slipping on a wet floor where there were no warning signs, or falling over poorly maintained surfaces, you may be able to seek compensation for medical expenses, lost income, and pain and suffering.

Emma and Justin both provided the time and patience necessary to oversee a workers’ compensation claim that was thirteen years past the date of injury. I was originally unaware that I was even entitled to a settlement until they sat me down and clearly explained the situation to me. While Emma and Justin were hard at work on the case, the rest of the team supported me with any queries I had; I was never left wondering about an outcome or a pending situation.
Given how personal this was and how long I had been waiting for this claim to be resolved, I have nothing but respect for the teams at both PPL offices. They made what could have been a very difficult task look easy. I would also like to specifically thank you, Alyza, as well as Tracey and Jamie, for taking care of the extra paperwork and for patiently answering the questions I frequently repeated. I know I wasn’t always an easy client due to my injury and the added stress from the opposition’s insurers, but I am incredibly grateful. I thank the entire team at Peninsula Personal Injury Lawyers with a warm heart and the utmost respect. I would refer any friend or family member to the PPL group without hesitation.
Best regards,
J.Dylan

Many people think hiring a lawyer is expensive and risky, but that’s not the case at Peninsula Personal Injury Lawyers. We work on a No Win, No Fee basis, meaning if your Public Liability Claim is successful, the insurer pays your compensation, most of your legal costs, and any disbursements (such as medical reports and evidence). From your compensation, you’ll only pay the remaining legal costs, capped at 10% or the actual amount, whichever is less. Never more than 10%.
If your claim isn’t successful, you pay no legal fees. You’ll only need to reimburse us for any disbursements we’ve covered on your behalf, and we never ask for money up front. There are no hidden costs; we’re transparent from the start.
(e.g. if your claim came to $50,000 then you would only ever pay a maximum of $5,000 as a contribution to the legal fees)

In most cases, you must notify the owner/ occupier that you suffered injury as soon as practicable following the accident. In addition, you must commence legal proceedings within three years of the date of the accident otherwise your entitlements will be extinguished.
However, some exceptions may apply, especially for minors or people with disabilities, so it’s best to seek legal advice as soon as possible.
Public liability claims can arise from many situations, including:
> Slipping on a wet floor in a supermarket
> Tripping over uneven footpaths or poorly maintained surfaces
> Accidents in rental properties due to unsafe conditions
> Injuries caused by faulty equipment in gyms, venues, or playgrounds
> Dog attacks or animal-related injuries in public places
After an accident, you should:
1. Report the incident to the property owner, manager, or council.
2. Take photographs of the accident scene and your injuries.
3. Collect contact details of any witnesses.
4. Seek medical treatment and keep all records.
5. Contact a lawyer to discuss your claim.
To have a valid public liability claim, you must show that:
> The person or organisation owed you a duty of care.
> They breached that duty by being negligent.
> Their negligence caused your injury.
A personal injury lawyer can assess your circumstances and advise on your eligibility.
Claims are usually made against the organisation, business, or individual responsible for the property where the accident occurred. This could include local councils, shopping centres, landlords, schools, or event organisers who failed to ensure a safe environment.
A public liability accident claim is a legal claim for compensation if you’ve been injured in a public place or on private property due to someone else’s negligence. Examples include slips, trips, falls, or injuries in shopping centres, parks, workplaces, or rental properties.
When you engage PPIL you won’t pay anything throughout the whole claims process. Once we have settled your claim, we’ll then determine how much our services cost. The majority of our fees will be covered by the insurance company, and we also place a cap on the fees you pay which is based off of your claim.
So, if you do end up having to pay anything, it would only come to a maximum of 10% of your claim.
(e.g. if your claim came to $50,000 then you would only ever pay a maximum of $5,000 as a contribution to the legal fees)
