Are you eligible to claim?

If you have been injured and suffered a loss as a result of a criminal offence, you can file a Criminal Injuries Compensation Claim Application with the Assessor of Criminal Injuries Compensation.

If no one has been convicted for the offence but the Assessor is satisfied that there was an offence, you may still be entitled to compensation.

The process is non-adversarial (i.e. you don’t sue anyone) but is wholly dependent on the information you provide with your Application to the Assessor.

The legal process.

The key to this process is ensuring that you provide sufficient detailed information, so the assessor has a clear understanding of how the offence has impacted your life.

This information can take the form of a very detailed statement from you and/or medical reports from relevant treating practitioners or specialist.

You must lodge the application within three years of the date of the offence. However, the assessor has discretion to accept claims (filed outside of this three year period).
